Terms of Service

Effective Date: January 22, 2026 Last Updated: January 24, 2026 Welcome to TeamBattles. These Terms of Service (“Terms”) govern your access to and use of the TeamBattles platform, website, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. IMPORTANT: These Terms contain a binding arbitration agreement and class action waiver in Section 20. Please read them carefully. You may opt out of arbitration within 30 days of creating your account as described in Section 20.5.

1. Acceptance of Terms

By creating an account, accessing, or using TeamBattles, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service. We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page, updating the “Last Updated” date, and sending you an email notification for significant changes. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

2. Eligibility

2.1 Age Requirements

To use TeamBattles, you must be at least 13 years of age (or the minimum age required by law in your jurisdiction). If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have your parent or guardian’s permission to use the Service. Jurisdiction-Specific Age Requirements:
  • Quebec, Canada: Users under 14 require parental consent.
  • Germany, Netherlands, Portugal: Users under 16 require parental consent for data processing.
  • South Korea: Real-name verification is required; minors require parental consent.
You must have the legal capacity to enter into a binding agreement and not be prohibited from using the Service under applicable laws. By using the Service, you represent and warrant that you meet all eligibility requirements.

2.3 Age Verification

We collect your date of birth during registration to verify eligibility. Users who indicate they are under 13 cannot create accounts. We use a neutral date entry format (not a dropdown starting at age 13) to collect accurate information.

3. Account Registration and Security

3.1 Account Creation

To access certain features of the Service, you must create an account using one of our supported OAuth providers: Discord, Twitch, GitHub, or Battle.net. You must keep at least one login provider connected to your account at all times. You agree to provide accurate and complete information during registration, keep your account credentials secure, notify us immediately of any unauthorized access to your account, and accept responsibility for all activities that occur under your account.

3.2 Username and Display Name

You may select a username (3-30 characters, letters, numbers, and underscores only) and display name (1-50 characters) for your account. You agree not to select or use a username or display name that impersonates another person or entity, contains offensive, vulgar, or inappropriate content, infringes on any trademark or other proprietary rights, or violates any applicable laws or regulations. We reserve the right to change or remove any username or display name that violates these Terms.

3.3 Profile Information

You may provide optional profile information including a bio (up to 500 characters), pronouns (up to 50 characters), birthday, country, timezone, and preferred languages (up to 10). You may upload a profile avatar (up to 1 MB) and banner (up to 2 MB). Uploaded images replace previous versions; no image history is maintained.

3.4 Account Termination by You

You may request deletion of your account by contacting support. Before account deletion, you must transfer ownership of any organizations you own to another member. Upon account deletion, you will lose access to all virtual goods, tokens, and subscription benefits, and no refunds will be issued except as required by law.

3.5 Account Suspension and Termination by Us

We reserve the right to suspend or terminate your account for violation of these Terms, fraudulent, abusive, or illegal activity, extended inactivity (accounts inactive for more than 2 years may be deleted), or at our discretion with or without cause.

3.6 Effect of Termination

Upon termination, your right to use the Service immediately ceases. You will lose access to all tokens, virtual goods, and subscription benefits. We are not obligated to refund any amounts paid, except as required by applicable law. Data will be handled in accordance with our Privacy Policy.

3.7 Appeal Process

If your account is suspended or terminated, you may appeal by contacting support@teambattles.gg within 30 days. Your appeal must include your username, the reason you believe the action was in error, and any supporting information. We will review appeals within 14 days and respond with our decision. Appeals are reviewed by human moderators, not solely by automated systems. Our decision on appeal is final. For EU Users (Digital Services Act Compliance): You will receive a statement of reasons for any content moderation decision, identification of which Terms were violated, information about how to appeal, and confirmation that appeals are reviewed by qualified human reviewers.

4. User Conduct

You agree to use the Service in a manner consistent with all applicable laws and regulations. You agree NOT to engage in the following prohibited conduct:

4.1 Cheating and Unfair Play

This includes using cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party software; exploiting bugs, glitches, or vulnerabilities in the Service or any games; manipulating match results or engaging in match-fixing; using any form of boosting or account sharing to artificially inflate rankings or statistics; and submitting false or manipulated scores or screenshots.

4.2 Harassment and Abuse

This includes harassing, threatening, stalking, or intimidating other users; using hate speech, slurs, or discriminatory language; engaging in bullying or toxic behavior in match chat or elsewhere on the platform; doxing or sharing personal information of other users without their consent; and reporting messages in bad faith.

4.3 Fraud and Misrepresentation

This includes creating multiple accounts to circumvent bans or restrictions, impersonating TeamBattles staff, moderators, or other users, providing false information in match disputes or support tickets, engaging in scams or fraudulent activities, and abusing invite systems or join requests.

4.4 Technical Abuse

This includes attempting to gain unauthorized access to other users’ accounts, interfering with or disrupting the Service or servers, circumventing any security measures or access controls, reverse engineering or decompiling any part of the Service, and abusing rate limits or overwhelming the Service with automated requests.

4.5 Enforcement

Violations may result in warnings, temporary suspension (24 hours to 30 days depending on severity), permanent account termination, or hardware ID bans for severe or repeated violations.

5. Organizations and Teams

5.1 Creating Organizations and Teams

You may create organizations and teams subject to the following requirements. Organization names must be 3-50 characters (letters, numbers, and spaces only) with tags of 2-6 uppercase characters. Team tags must be 2-5 uppercase characters and be unique within the organization. Team names must be unique within the parent organization.

5.2 Roles and Responsibilities

Organizations have four roles with descending permissions: Owner (full control including deletion and ownership transfer), Admin (member and team management), Manager (limited management and invites), and Member (basic access). Teams have three roles: Captain (full control including deletion and score submission), Co-Captain (management except deletion), and Member (participation only). Each team has exactly one Captain. Promoting someone to Captain automatically demotes you to Co-Captain.

5.3 Member Management

Organization owners and team captains are responsible for the conduct of their members. Repeated violations by members may result in penalties for the organization or team. You may ban users from your organization (temporarily or permanently), and banned users cannot rejoin, be re-invited, or request to join until the ban is lifted.

5.4 Invites and Join Requests

You may create invite links for organizations and teams. Invite links can have configurable maximum uses and optional expiration dates. Join requests remain pending until manually reviewed and do not automatically expire. You must not abuse invite systems to spam users or circumvent restrictions.

6. Matches

6.1 Match Creation and Participation

When creating matches, you must select appropriate game settings including series length (Best of 1, 3, 5, or 7), map selection type (Competitive or Flex pool), and scheduling. Scheduled matches must be at least 1 hour in the future and no more than 7 days in advance. Each match requires at least one active player on the roster.

6.2 Match Integrity and Fair Play

When participating in matches on TeamBattles, you agree to compete fairly and honestly, follow all posted match rules and game settings, submit accurate scores and evidence, respect match schedules and check-in requirements, and communicate respectfully with opponents in match chat.

6.3 Score Submission and Verification

Captains are responsible for submitting scores after matches. You may upload up to 10 screenshots (up to 2 MB each) as evidence. Both teams must confirm scores for the match to be marked complete. Submitting false or manipulated scores is grounds for account suspension.

6.4 Disputes

If you believe there has been a violation of match rules, you may file a dispute within 24 hours of match completion. You agree to submit disputes in good faith with accurate information, provide evidence to support your claims (screenshots, recordings, logs), and accept the final decision of TeamBattles administrators. We will provide an initial review within 48 hours and a final decision within 7 days. Filing false or frivolous disputes may result in penalties or account suspension. Only one open dispute ticket may exist per match. Available remedies include match reversal, match replay, player suspension, and prize forfeiture (if applicable).

6.5 Forfeits and No-Shows

Teams that fail to check in or participate in scheduled matches may be issued forfeits, with a win awarded to the opposing team. Repeated no-shows may result in account restrictions.

6.6 Roster and Attendance

Players can set attendance status (Attending, Not Attending, or Tentative) for matches. When active roster players change to Not Attending, bench players may be automatically promoted based on priority order. You are responsible for maintaining accurate attendance information.

7. Match Chat

7.1 Chat Availability and Usage

Chat rooms are automatically created when matches are accepted and remain available during Accepted, Ready, and In Progress statuses. You may send text messages (up to 255 characters) and images (up to 2 MB each, maximum 10 images per team per match). Messages are rate-limited to 5 per minute.

7.2 Chat Conduct

You must communicate respectfully with opponents. Harassment, hate speech, spam, and inappropriate content are prohibited in match chat. You may report messages that violate these Terms.

7.3 Chat Deletion

All chat messages, images, and reactions are automatically and permanently deleted 48 hours after a match is completed. This deletion is automatic and cannot be prevented or reversed. You are responsible for saving any important information before deletion.

7.4 Default Chat Settings for Minors

For users under 18, chat notifications and sounds are disabled by default. Users may enable these features in settings.

8. Content and Intellectual Property

8.1 User Content

You retain ownership of any content you submit to the Service, including profile images, team logos, chat messages, and screenshots (“User Content”). By submitting User Content, you grant TeamBattles a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with operating and promoting the Service. You represent and warrant that you own or have the necessary rights to submit User Content, your User Content does not infringe on any third-party rights, and your User Content complies with these Terms and all applicable laws.

8.2 File Upload Limits

Avatars (profile, organization, team) are limited to 1 MB and replace previous uploads. Banners (profile, organization, team) are limited to 2 MB and replace previous uploads. Match screenshots are limited to 2 MB each with a maximum of 10 per match. Chat images are limited to 2 MB each with a maximum of 10 per team per match. Support ticket images are limited to 2 MB each with a maximum of 10 per ticket.

8.3 TeamBattles Content

The Service and its original content (excluding User Content), features, and functionality are owned by TeamBattles and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any TeamBattles content without our express written permission.

8.4 Prohibited Content

You may not submit User Content that is illegal, harmful, threatening, abusive, or defamatory; contains sexually explicit material or pornography; promotes violence, terrorism, or illegal activities; infringes on intellectual property rights; contains malware, viruses, or harmful code; or is spam or commercial advertising (unless authorized).

8.5 DMCA Policy

TeamBattles respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). Designated Agent: Our designated agent for receiving DMCA takedown notices is available at dmca@teambattles.gg. Filing a Notice: If you believe your copyrighted work has been infringed, send a notice to our designated agent containing identification of the copyrighted work, identification of the infringing material with sufficient information for us to locate it, your contact information, a statement that you have a good faith belief the use is not authorized, a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner, and your physical or electronic signature. Counter-Notification: If you believe your content was removed in error, you may file a counter-notification with your contact information, identification of the removed content, a statement under penalty of perjury that you have a good faith belief the content was removed in error, consent to federal court jurisdiction, and your signature. Repeat Infringer Policy: We will terminate accounts of users who are repeat infringers. Users who receive three valid DMCA notices will have their accounts permanently terminated.

9. Payments, Subscriptions, and Virtual Currency

9.1 Payment Processing

All payments are processed by Xsolla Inc. (“Xsolla”). When you make a purchase, you are also agreeing to Xsolla’s Terms of Service (https://xsolla.com/eula) and Privacy Policy (https://xsolla.com/privacypolicy). TeamBattles does not receive or store your payment card information. For payment-related inquiries, contact Xsolla at help.xsolla.com.

9.2 Token Purchases

TeamBattles offers virtual currency (“Tokens”) that can be used to purchase platform features and services. IMPORTANT LICENSE DISCLOSURE: When you “purchase” Tokens, you are acquiring a LIMITED LICENSE to access certain platform features—NOT ownership of property. Tokens have no monetary value outside TeamBattles and cannot be exchanged for cash, transferred to other users, or redeemed outside the Service. By completing a Token purchase, you acknowledge that:
  • You are receiving a license to use virtual items, not ownership of goods
  • Tokens may only be used within TeamBattles for designated features
  • Tokens have no cash value and are non-refundable except as required by law
  • Your Token license may be revoked upon account termination
  • TeamBattles may discontinue Tokens or modify their value with reasonable notice

All prices are in USD. Prices may vary by region and are subject to applicable taxes.

9.3 Subscriptions

TeamBattles offers subscription plans that provide enhanced features. AUTOMATIC RENEWAL DISCLOSURE (California Automatic Renewal Law Compliance): Your subscription will automatically renew at the end of each billing period at the then-current rate unless you cancel. You authorize us to charge your payment method on file for each renewal period until you cancel. Subscription Tiers:
  • Basic: $4.99/month
  • Standard: $9.99/month
  • Premium: $19.99/month
Before subscribing, you acknowledge:
  • Your subscription automatically renews monthly until cancelled
  • You will be charged the subscription fee each month on your billing date
  • Subscription fees may change with 30 days’ advance notice
  • You may cancel at any time; cancellation takes effect at the end of the current billing period

9.4 Cancellation

How to Cancel: You may cancel your subscription at any time through your Account Settings or by clicking the “Cancel Subscription” link in your subscription management page. You may also cancel by contacting support@teambattles.gg. Effect of Cancellation: Upon cancellation, you will retain access to subscription benefits until the end of your current billing period. No prorated refunds are provided for partial billing periods except as required by law. Annual Reminder: We will send you an annual reminder about your subscription, including the current fee, next renewal date, and cancellation instructions.

9.5 Refunds

Token purchases are generally non-refundable. Subscription fees are generally non-refundable, but you may request a refund within 14 days of your initial subscription if you have not used subscription benefits. EU Right of Withdrawal: If you are an EU consumer, you have a 14-day right of withdrawal for digital content purchases. However, you agree that by making a purchase and checking the acknowledgment box, you consent to immediate performance and acknowledge that you lose your right of withdrawal once the digital content (Tokens or subscription access) is provided. Refund Requests: To request a refund, contact Xsolla at help.xsolla.com or TeamBattles support at support@teambattles.gg.

9.6 Price Changes

We may change subscription prices with at least 30 days’ advance notice. Price changes take effect at the start of your next billing period following the notice. If you do not agree to a price change, you may cancel before the new price takes effect.

9.7 Taxes

Prices may be subject to applicable sales tax, VAT, or other taxes depending on your location. You are responsible for all applicable taxes.

10. Tournaments and Competitive Events

10.1 Entry Fees and Prizes

TeamBattles may offer competitive events with entry fees and prizes. Entry fees are characterized as administrative fees to cover operational costs of running events. Prize pools are announced before registration opens with fixed distribution percentages.

10.2 Skill-Based Competition

All competitive events on TeamBattles are skill-based competitions where the outcome is determined predominantly by player skill, not chance. Events use skill-based matchmaking (seeded brackets, ELO systems) to ensure fair competition.

10.3 Geographic Restrictions

Due to varying state and international regulations, users in certain jurisdictions may be restricted from participating in paid competitive events. Users in Louisiana and Montana are not eligible to participate in events with entry fees or prizes. Users in New York may face additional registration requirements for events with prizes exceeding 5,000.UsersinFloridamayfacebondingrequirementsforeventswithprizesexceeding5,000. Users in Florida may face bonding requirements for events with prizes exceeding 5,000. International users may face restrictions based on local laws. You are responsible for ensuring your participation complies with your local laws.

10.4 Tax Obligations

If you win prizes valued at 600ormore(cumulativeinacalendaryear),youmayberequiredtoprovidetaxinformation(W9forUSresidents,W8BENforinternationalparticipants).TeamBattleswillissueIRSForm1099MISCforUSwinnersreceiving600 or more (cumulative in a calendar year), you may be required to provide tax information (W-9 for US residents, W-8BEN for international participants). TeamBattles will issue IRS Form 1099-MISC for US winners receiving 600 or more. International winners may be subject to 30% withholding. You are responsible for reporting and paying any taxes owed on prize winnings.

10.5 Publisher Restrictions

Competitive events may be subject to game publisher guidelines. We comply with applicable publisher requirements for community tournaments. TeamBattles competitive events are not affiliated with, sponsored by, or endorsed by any game publisher unless explicitly stated.

11. API Access

11.1 API Keys

You may create up to 5 API keys per account through Developer Settings. Each key has a customizable label (1-50 characters) and granular permission controls. API keys are shown only once at creation and cannot be retrieved afterward. You are responsible for storing keys securely.

11.2 API Usage

API keys authenticate third-party applications to access your TeamBattles data according to the permissions you grant. Permissions include matches access (at user, team, or organization level) with read-only or read-write capabilities, and connection access (Discord, Twitch, GitHub, Battle.net) that allows applications to use your linked platform data.

11.3 API Acceptable Use

You agree not to share API keys with unauthorized parties; use API access to scrape data, harass users, or violate these Terms; exceed rate limits (documented in API documentation); use API access to circumvent platform features or restrictions; create applications that violate the terms of connected third-party platforms; use API data for machine learning or AI training without explicit permission; or commercialize API data without authorization.

11.4 Developer Obligations

If you develop applications using our API, you must maintain a privacy policy compliant with applicable laws, require your users to agree to terms consistent with these Terms, implement appropriate data security measures, delete user data within 30 days of user request or API key revocation, notify TeamBattles within 24 hours of any data breach, and comply with applicable data protection laws.

11.5 API Key Revocation

You may delete API keys at any time, which immediately revokes all access. We reserve the right to revoke API keys that are used in violation of these Terms without notice.

12. Anti-Cheat and Monitoring

12.1 Monitoring Technology

TeamBattles employs monitoring technology to detect and prevent cheating, fraud, and abuse. This may include collection of hardware identifiers, analysis of behavioral patterns, integration with third-party anti-cheat services, and automated detection systems.

12.2 Disclosure

We do not disclose specific detection methods to preserve platform integrity. By using the Service, you consent to this monitoring as described in our Privacy Policy.

12.3 Hardware Bans

For severe or repeated violations, we may implement hardware ID (HWID) bans that prevent access from specific devices. HWID bans are reserved for cheating, hacking, ban evasion, and egregious Terms violations.

13. Support System

13.1 Support Tickets

You may create support tickets for issues related to your account, organizations, teams, or matches. You are limited to 5 open tickets at a time. Tickets require a subject (5-100 characters) and description (10-5,000 characters).

13.2 Ticket Conduct

You agree to submit tickets in good faith with accurate information, respond to support staff requests in a timely manner, and not abuse the support system with frivolous or repetitive tickets.

13.3 Ticket Members

You may add up to 10 members (including yourself) to a ticket to share access. Members can be granted Participant (view and reply) or View Only access.

14. Experience and Achievements

14.1 Experience Points

Teams earn experience (XP) through match wins and completing objectives. For regular teams, experience is displayed as “XP.” For league teams, experience is divided by 10 and displayed as “points.” Experience values may be decimal and are displayed with one decimal place when needed.

14.2 Achievements

Achievements are unlocked automatically as you use the platform. Achievement progress, unlock dates, and rarity percentages are tracked and may be displayed on your profile based on your visibility settings. You may not attempt to artificially unlock achievements through exploits or manipulation.

15. Third-Party Services and Game Publishers

15.1 Third-Party Services

The Service integrates with third-party services and game platforms (such as Activision, Steam, PlayStation Network, Xbox Live, Discord, Twitch, and others). Your use of these third-party services is subject to their respective terms of service and privacy policies. TeamBattles is not responsible for the practices of third-party services.

15.2 Required Platform Connections

Certain features require specific platform connections. For example, Call of Duty matches require all participating players to have linked Activision accounts.

15.3 Publisher Disclaimers

TeamBattles is an independent platform and is not affiliated with, sponsored by, or endorsed by Activision Blizzard, Riot Games, Valve Corporation, Electronic Arts, Epic Games, or any other game publisher unless explicitly stated. Game titles, logos, and trademarks are the property of their respective owners.

16. Disclaimers

16.1 “As Is” Service

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

16.2 No Guarantee

TeamBattles does not guarantee that the Service will be uninterrupted, secure, or error-free; that results obtained from using the Service will be accurate or reliable; that any defects in the Service will be corrected; or that real-time features (such as chat and notifications) will function without delay.

16.3 Third-Party Content

TeamBattles is not responsible for any third-party content, including User Content, and does not endorse any opinions expressed by users.

16.4 Virtual Goods

Virtual goods (including Tokens) are licensed, not sold. We do not guarantee the continued availability of any virtual goods and may modify or discontinue them at any time with reasonable notice.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEAMBATTLES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. IN NO EVENT SHALL TEAMBATTLES’ TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO TEAMBATTLES IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF YOU ARE A CONSUMER IN SUCH A JURISDICTION, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

18. Indemnification

You agree to indemnify and hold harmless TeamBattles, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any third-party rights, your User Content, your use of API keys or any applications you authorize, and your participation in competitive events.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. For EU consumers, this choice of law does not deprive you of mandatory consumer protections under the laws of your country of residence.

20. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

20.1 Informal Resolution

Before filing any claim, you agree to try to resolve the dispute informally by contacting support@teambattles.gg. We will attempt to resolve the dispute within 60 days. If we cannot resolve the dispute informally, either party may initiate arbitration.

20.2 Binding Arbitration

Any dispute arising from these Terms or your use of the Service that cannot be resolved informally shall be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration will be conducted in English, in the county where you reside or in Los Angeles, California, at your election.

20.3 Arbitration Fees

TeamBattles will pay all JAMS filing, administration, and arbitrator fees for any arbitration. You are responsible only for your own attorneys’ fees unless the arbitrator awards you attorneys’ fees.

20.4 Class Action Waiver

YOU AND TEAMBATTLES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this class action waiver is found unenforceable, then the entirety of this arbitration provision shall be null and void.

20.5 Opt-Out

You may opt out of this arbitration agreement by sending written notice to arbitration-optout@teambattles.gg within 30 days of creating your account. Your notice must include your name, username, email address, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, you may bring claims in court, but the class action waiver still applies to the extent permitted by law.

20.6 Small Claims Court

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court’s jurisdiction.

20.7 Exceptions

This arbitration agreement does not apply to claims for injunctive relief to stop unauthorized use or abuse of the Service, claims for intellectual property infringement, or claims that must be brought in court under applicable law.

20.8 Survival

This arbitration agreement survives termination of your account or these Terms.

21. General Provisions

21.1 Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and TeamBattles regarding the Service.

21.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.

21.3 Waiver

The failure of TeamBattles to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

21.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without TeamBattles’ prior written consent. TeamBattles may assign these Terms without restriction in connection with a merger, acquisition, or sale of assets.

21.5 Notices

We may provide notices to you via email to the address associated with your account, in-app notifications, or posting on the Service. You may provide notices to us at support@teambattles.gg.

21.6 Force Majeure

TeamBattles shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

21.7 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights, except that our affiliates are third-party beneficiaries of these Terms.

21.8 Export Compliance

You agree to comply with all applicable export and import laws and regulations. You may not use the Service if you are located in a country subject to U.S. embargo or if you are on any U.S. government list of prohibited or restricted parties.

21.9 Government Users

If you are a U.S. government user, the Service is provided as a “commercial item” under 48 C.F.R. § 2.101, consisting of “commercial computer software” and “commercial computer software documentation.”
